ELIGIBILITY:

This giveaway is open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older at the date of entry. Employees of DHC USA Inc. (“DHC”) and their immediate families are not eligible to participate. Residents of jurisdictions / states that prohibit such promotions should consider this offer void.

HOW TO ENTER:

To enter the giveaway, you must complete the following steps:

• Step 1: Access your Instagram account. If you do not already have an Instagram account, visit Instagram and follow the instructions to create an account, subject to terms determined by Instagram. Instagram is free, however, data rates may apply if accessing from your mobile device. Your Instagram profile must be public and viewable by DHC. Please make sure the privacy restrictions for your post are set to permit public viewing during the contest period.  
• Step 2: Follow @DHCSkincare during the giveaway period, like the Giveaway post and tag one (1) of your friends in the comments.

By entering the giveaway, each entrant understands and agrees that the entrant’s post may and will be accessible for viewing by the general public and any such posting will be deemed made at the direction of the Entrant within the meaning of the Digital Millennium Copyright Act and the Communications Decency Act.

PROHIBITED CONTENT:

All entries must be the original work of the entrant and not violate the rights of any other party, including but not limited to intellectual property rights or rights of privacy/publicity. DHC reserves the right to disqualify any entry that violates this prohibition, or which DHC deems inappropriate for any reason, in DHC’s sole discretion.

WINNER SELECTION:

The winning Entrants will be notified via Instagram direct message. The potential winning Entrants must respond to DHC’s prize notification message within 72 hours from that date and time of the DHC’s prize notification message. In the event that a potential winning Entrant does not respond to DHC’s prize notification message within the specified time, a new winner will be chosen randomly. Alternate winners will be contacted via Instagram direct message and must respond to the DHC’s prize notification message within 72 hours from that date and time of the DHC’s prize notification message.

GENERAL RULES:

By entering this giveaway, Entrants affirm that they have read and accepted these Official Rules and agree to be bound by them. This giveaway is not endorsed by Instagram. Entries that are lost, late, misdirected, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion, or incompatibility of servers, will not be eligible and DHC has no liability for any such entries. Anyone found to be using multiple Instagram accounts to enter will be ineligible. All entries become the property of DHC and will not be acknowledged or returned. DHC reserves the right, in its sole discretion, to disqualify any person suspected of tampering with the entry process or attempting to automate the entry process, or otherwise violate these Official Rules. DHC further reserves the right to cancel, terminate, or modify any promotion not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, or technical failures of any sort. Income and other taxes, if any, are the sole responsibility of winners. The giveaway is subject to all federal, state and local laws and regulations. Void outside of the 50 United States and the District of Columbia, and where prohibited by law. The odds of winning depend on the number of entries received. Prizes are not transferable. No substitutions for prizes except by DHC, in which case a prize of equal or greater value will be substituted.

By accepting a prize, the winners consent to the use of their names, Instagram user names, voices or likenesses for publicity, advertising, or promotional purposes in any media whatsoever without further compensation or permission (except where prohibited by law), and winners hereby release DHC and its designees from any liability with respect to such usage. By participating in the giveaway, Entrants agree to release and hold DHC and Instagram harmless from any and all liability with respect to or in any way arising from or in connection with this giveaway and/or the acceptance and use of the prize, including liability for personal injury, bodily injury, death, damages or loss. The failure of DHC to comply with any provisions of these Official Rules due to an act of God, act of terrorism, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside the control of DHC (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules. DHC is not responsible for any typographical or other errors in the printing, the offering or the announcement of any prizes or in the administration of the giveaway. If any technical errors occur in the selection of a potential prize winner or if more prizes are claimed than the number of prizes being awarded as provided in these Official Rules, DHC may award the prizes by random drawing among all eligible claimants.

LIMITATIONS OF LIABILITY:

DHC is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the giveaway; (ii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iii) unauthorized human intervention in any part of the entry process or the giveaway; (iv) electronic, clerical or human error which may occur in the administration of the giveaway or the transmission, receipt or processing of entries or notification of winners; (v) lost, misdirected, illegible or incomplete registrations, review or entries nor any change of the email address or, Instagram account of entrants; or (vi) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware, or software, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the giveaway. Without limiting the generality of the foregoing, DHC reserves the right in its sole discretion to terminate, modify, cancel or suspend this giveaway if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming or any other errors or other causes beyond the control of DHC corrupt the administration, security or proper play of the giveaway.

To the extent allowable under applicable law, under no circumstances, including negligence, shall DHC be liable for any direct, indirect, incidental, special or consequential damages that result from the use or misuse of the prize or participation in the giveaway, or out of any breach of any warranty. WITHOUT LIMITING THE FOREGOING, THE PRIZES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
